§ 20-350. Eminent domain—Authority.

  • (a)

    This section is enacted pursuant to Article 5 of the Bill of Rights and the XIV Amendment of the U.S. Constitution, Article X, Section 6 of the Florida Constitution, and Section 127.01, Florida Statutes.

    (b)

    Eminent domain shall not be used as a means to acquire property from private persons or entities without the consent of the owner of said property, only to subsequently transfer the property to other private parties to be used for the nonpublic purposes of private development, economic gain and/or to increase tax revenues; and

    (c)

    Land acquired through eminent domain must be reasonably necessary for the public purpose: and

    (d)

    Full compensation for land acquired through eminent domain shall be paid to the property owner pursuant to Florida Law.
