§ 27-205. Flow control.

  • (a)

    All solid waste generated within the unincorporated areas of the county shall be disposed of as provided by the county in an agreement or by rule or regulation.

    (b)

    It shall be unlawful for any person to dispose of any solid waste within the area of the county subject to the jurisdiction of this article when such solid waste was not generated within the area of jurisdiction unless an appropriate interlocal agreement or other disposal agreement authorizing such disposal has been approved by the governing body of the county.

    (c)

    It shall be unlawful for any person to transport or dispose of solid waste required to be placed in the county's solid waste disposal system outside the system.

    (d)

    Failure to dispose of solid waste as required by this section shall constitute a violation of this article.

    (e)

    Collection, transport and/or disposal of hazardous waste is prohibited without an agreement with or permit from the county. Household hazardous waste shall be disposed of at the county designated landfill.

    (f)

    If a residential customer's collection service is properly terminated due to nonpayment, any solid waste that is left on the property unattended and not disposed of legally and properly shall result in enforcement action. Further, any residential solid waste or special waste improperly disposed of shall result in enforcement action. Any such enforcement actions shall require the residential customer or the person improperly disposing of waste to pay the reasonable attorneys' fees, costs and expenses of the county in bringing the enforcement action.
